Terms of Service
Welcome to JewelTry. These Terms of Service ("Terms") govern your access to and use of the JewelTry platform, website (jeweltry.app), and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Acceptance of Terms
By creating an account or using any part of the Service, you confirm that you are at least 18 years of age and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
These Terms constitute a legally binding agreement between you and JewelTry. We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Service Description
JewelTry is an AI-powered virtual jewelry try-on marketplace that provides two primary services:
- For Jewelers: A SaaS platform enabling jewelers to showcase their products with virtual try-on capabilities, receive customer leads, and manage their online storefront.
- For Customers: A marketplace to browse jewelry collections from verified jewelers, virtually preview products using augmented reality technology, and connect with jewelers for purchases.
The virtual try-on feature uses client-side image processing to overlay jewelry assets on camera feeds. No camera data is transmitted to or stored on our servers. See our Privacy Policy for detailed information about camera data handling.
3. User Accounts
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials and not share your password
- Promptly update your account information if it changes
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods.
4. Jeweler Obligations
Jewelers who register on the JewelTry platform agree to the following additional obligations:
- Accurate Listings: All product information, including descriptions, materials, karat weight, stone details, and pricing, must be accurate and truthful.
- Quality Standards: Products listed must be genuine and of the quality described. Misrepresentation of materials or certifications is grounds for immediate account termination.
- Timely Responses: Jewelers are expected to respond to customer lead inquiries within 48 hours during business days.
- Subscription Compliance: Jeweler accounts are subject to subscription plan limits (product count, features). Exceeding plan limits requires an upgrade.
- Legal Compliance: Jewelers must comply with all applicable laws regarding jewelry sales, hallmarking, certification, and consumer protection in their operating jurisdiction.
- Image Rights: Jewelers warrant that they own or have proper licenses for all images and content uploaded to the platform.
5. Customer Use
As a customer using JewelTry, you agree to:
- Use the Service for personal, non-commercial purposes unless otherwise agreed
- Provide accurate information when submitting lead inquiries or contact requests to jewelers
- Not use the virtual try-on feature to create misleading or inappropriate content
- Not attempt to circumvent the platform to contact jewelers for the purpose of avoiding JewelTry's referral tracking
- Not scrape, crawl, or automatically collect data from the Service without written permission
- Not attempt to reverse-engineer, decompile, or extract the source code of the virtual try-on technology
6. Intellectual Property
The JewelTry platform, including its design, code, virtual try-on technology, branding, and all associated intellectual property, is owned by JewelTry and protected by applicable intellectual property laws.
- Platform IP: All rights to the JewelTry software, algorithms, user interface designs, and trademarks are reserved.
- Jeweler Content: Jewelers retain ownership of their product images and descriptions. By uploading content, jewelers grant JewelTry a non-exclusive, royalty-free license to display, distribute, and promote that content on the platform and in marketing materials.
- User Feedback: Any feedback, suggestions, or ideas you submit regarding the Service may be used by JewelTry without obligation to compensate you.
7. Limitation of Liability
To the maximum extent permitted by law:
- JewelTry provides the Service "as is" and "as available" without warranties of any kind, express or implied.
- JewelTry is not responsible for the quality, safety, or legality of products listed by jewelers on the platform.
- JewelTry acts as a marketplace and technology provider. Transactions between customers and jewelers are conducted directly between those parties.
- JewelTry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claims related to the Service shall not exceed the amount paid by you (if any) for the Service in the 12 months prior to the claim.
The virtual try-on feature provides an approximate visual representation. Actual product appearance may vary from the virtual preview. JewelTry makes no warranties regarding the accuracy of virtual try-on representations.
8. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. For significant changes that affect your use of the Service, we will provide reasonable advance notice via email or an in-platform notification.
Changes to these Terms will be posted on this page with an updated "Last updated" date. For material changes, we will notify registered users via email at least 14 days before the changes take effect.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved as follows:
- Informal Resolution: We encourage you to contact us first at hello@jeweltry.app to attempt to resolve any dispute informally.
- Mediation: If informal resolution fails, the parties agree to attempt mediation before pursuing formal proceedings.
- Jurisdiction: Any formal legal proceedings shall be brought exclusively in the courts of Istanbul, Turkey.
